We do not own, control, inspect, or guarantee any of the items listed on the platform.
BorrowBay is not a party to any rental agreement made between users.
All transactions are done at your own risk and discretion.

2. User Responsibility

You are fully responsible for your interactions and rental activities on BorrowBay. This includes:

• Verifying the identity and trustworthiness of other users before handing over or accepting any item.

• Inspecting the condition and suitability of any item before renting or listing.

• Agreeing to rental terms (duration, pricing, deposit, usage, etc.) clearly with the other party.

BorrowBay is not responsible for any loss, theft, misuse, or disputes arising between users.

3. Theft, Damage, or Personal Loss

BorrowBay shall not be held liable for any of the following:

• Stolen or unreturned items

• Damaged or malfunctioning items

• Loss or theft of personal belongings

• Any illegal usage or misuse of rented items

• Personal injury, property damage, or financial loss resulting from any rental transaction

We strongly advise users to:

• Request ID verification or security deposits if necessary

• Take photos or videos of item condition before and after rental

• Communicate clearly and keep written proof of terms

4. Prohibited Items

You may not list or rent out:

• Illegal, stolen, or counterfeit items

• Hazardous materials, weapons, or explosives

• Personal or intimate items that pose hygiene or privacy concerns

• Anything that violates local, state, or national laws

BorrowBay reserves the right to remove any listing at its sole discretion.

5. Payments and Fees

• BorrowBay may charge a commission or platform fee for enabling rentals.

• Payment methods will be specified on the site or app.

• We are not responsible for off-platform payments or transactions.

• Users should avoid dealing in cash unless mutually trusted.

6. Verification & Trust

While BorrowBay may offer basic verification options (e.g., phone/email), we do not certify, verify, or guarantee the identity, reputation, or reliability of users.
It is your sole responsibility to assess whom you deal with.

7. User Conduct

You agree not to:

• Misrepresent yourself or your listings

• Use the platform for fraud, abuse, or illegal activity

• Violate others’ privacy or intellectual property

• Harass or threaten any user or staff

Violation may result in account suspension or legal action.

8. Disputes Between Users

BorrowBay is not obligated to mediate or resolve user disputes.
However, we may suspend or block accounts that are repeatedly reported for unethical conduct or unresolved issues.

9. Termination of Access

BorrowBay reserves the right to suspend, restrict, or delete any user account that violates these Terms or harms the platform experience.

10. Limitation of Liability

To the maximum extent allowed by law, BorrowBay is not liable for any direct, indirect, incidental, or consequential damages arising out of your use of the platform or interactions with other users.

11. Changes to Terms

These terms may be updated periodically. It is your responsibility to review them regularly. Continued use of the platform indicates your agreement to any changes.
